Can two companies in the same state have similar names?
Below are a couple examples. Can two business' exist with names similar in the same industry in the same state? Any references would be appreciated. Thanks.

Most states prohibit names that could be "confusingly similar" to any existing name. However, Mr. Morris could own Morris Images for his graphic design studio, and could also own Morris Images Photography for his photo studio. Problems arise when using a common last name as part of your business name. Two unrelated people in the same state/area owning "Taylor Painting" and "Taylor Paints" are likely to run into difficulties. They might be required to change names to Taylor Painting Service and Taylor Paint & Hardware Store or some such.
With something like "Elite" and other popularly chosen words, you will very likely run into problems.
You will have check for details with your state's corporations divisions at the secretary of the State's office for corporations, LLCs, etc. Check with your County Clerk or City Clerk regarding registration of a sole proprietorship. Each state can be a little different, so you have to verify the specific rules for your area.
